This Privacy Policy clarifies how Her Yes Club Inc. (“Her Yes Club, “we,”or” “us” ) collects and uses your personal information to provide our services to you, and who to contact should you have questions. The terms “you,” “your,” and “yours” refer to the user (end user) utilizing the Service. This Privacy Policy pertains to personal information we collect when you use our websites www.heryesclub.ca, mobile applications (IOS and Android) and other related online products and services (collectively, the “Service” or “Services”) or when you otherwise connect with us (email, text, telephone). This Privacy Policy does not apply to websites, applications, or services that display or link to other privacy statements.

This Privacy Policy may be amended without notice. You will be notified at the top of this page with corresponding dates of such changes. If we make significant changes, we will provide you with notification through the Services or through other means, such as email. Please review the Privacy Policy regularly whenever you access the Services, or otherwise interact with us, to stay informed about our privacy practices and the ways in which you can exercise choice over these practices. We are subject to the applicable laws of the locations in which we operate and as such, will only participate in practices described in this policy if permitted under the laws of that location. Capitalized terms used but not defined in this Privacy Policy have the meanings given to them in the Terms of Use.

Collection and Use of Personal Information

The information we collect differs based on how you interact with us, which Services you use, and the selections you make. Following your consent, we will collect and process information about you to provide the offerings of Her Yes Club, inclusive of services, and possibly products. We follow these practices in order to meet our legal and contractual obligations, protect the security of our systems, our users, and fulfill other reasonable interests.

We collect information about you in various ways when you use our Services, involving information you provide directly, information collected routinely, and information collected via third-party data sources.

Information Collected

When you use our Services, we may collect personal information in some of the following ways:

User-Provided Information

When you sign up or register to use the Site, we will ask you to provide certain information, such as your first name, last name, home address, phone number, email address, and personal information, including information regarding your children, which may be considered “personally identifiable information.” You may also provide personally identifiable information to us such as your mailing address, phone number, and other information when you send us an email, when you update the information you’ve previously provided to us, when you Request Care, or at other times when accessing the Services.

Automatically Collected Information

When you use the Service we may automatically record certain information about or related to your use of the Service that is made available through your computer such as your IP address, information about your hardware and software, links, images, or other materials you click, information that may enable us to approximate your location, web pages or sites that you visited just before or just after the Service, the pages you view on the Service, the searches you run on the Service, the dates and times you access the Service, and other information about how you use the Service. This information may be collected through the use of different types of technologies, such as standard log files, cookies, and web beacons (sometimes called “clear GIFs”).

Location Information

In addition to automatically collected information, we may request that your device provide us your location information, including GPS and other location data made available by your device. Depending on the configuration of your device, you may be able to request that this information is not sent to us while continuing to use the Service. Even where you disable our access to your location information, we may still be able to estimate your location based on your IP address, or you may provide us other information connected to your location, such as your mailing address, either directly or through an Integrated Service.

Third-Party Login Functionality

Via our IOS or android application, you may be given the option to access or register through the use of your user name and passwords for other services (each an “Integrated Service”), such as through the use of your Facebook or Google credentials.

If you connect your account with Facebook, you understand and authorize us to access and store the credentials you provide, a unique identifying number or string of characters associated with you, your name, email address(es), date of birth, gender, current city, address information, profile picture URL, and other information associated with your Facebook account that you permit Facebook to make available to us.

If you choose to connect using an Integrated Service other than Facebook or Google, you authorize us to access and store accessible information from such Integrated Service. We suggest that you review your Facebook or other Integrated Service privacy settings to understand and change the information available to us.

Information Use 

The Site may use the information you provide or that we collect to develop, operate, support, maintain, enhance, and provide the Service, to analyze and develop our marketing strategy, Service, and other technologies, to develop new products and services, and to customize and target content that may be more interesting, relevant, or useful to you, including advertisements, and for other administrative purposes, for example:

  • to contact you for feedback about the Service;
  • to conduct research about the Service;
  • to provide anonymous reporting for internal and external purposes;
  • to provide you with certain features or services that may be relevant based on information you’ve provided to us;
  • to investigate user or Provider complaints;
  • to notify you of technical updates or changes in policy, or;
  • to contact you for marketing and promotional purposes.

You can opt-out of receiving certain communications, but we reserve the right to continue to send you certain communications relating to the Service, such as updates from your Provider and administrative messages, without offering you the opportunity to opt out of receiving them.

Information sharing and disclosure 

For Providers

Any data that you include on your profile will be seen by others. Your profile is visible to all Registered Users searching for care, and any users onboarded by you as an existing client.

For Parents

Your profile information such as name, location, and contact information, as well as information you provide about your child(ren) will be visible to Providers you initiate contact with and/or accept as a childcare provider. Personal information about your child(ren) will not be visible to other parents or providers you do not accept as a caregiver.

Third parties

We may provide your information to third parties for their use in helping us perform our internal business functions. This includes performing maintenance, security, data analysis, email transmissions, or data hosting on our behalf. We require these third parties to maintain your information consistent with their legal obligations.

Change in control or sale

We may disclose and otherwise transfer your information to an acquirer, or to a successor or assignee, as part of any merger, acquisition, debt financing, sale of all or a portion of our assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership, in which your information is transferred to one or more third parties as one of our business assets.

Customer support

We may use your information and data (which can include your communications) to investigate, respond to and resolve complaints and for Service issues (e.g., bugs).

Security and investigations

We may disclose your information if required to do so by law or in the good faith belief that disclosure is necessary to: (1) satisfy legal obligations or comply with legal process (such as a subpoena) served on the Site; (2) protect the Site and others from fraudulent, abusive, predatory, or unlawful uses or activity; (3) investigate and defend the Site against any legal claims or threats; (4) protect and defend the rights or property of the Site; (5) take action relating to user complaints, or (6) act in urgent circumstances to protect (a) the personal safety of users of the Site, (b) the Service, (c) or the public.

Choice 

It is always your choice to decline when asked to provide personal information, although choosing not to provide pertinent information may result in features or products being unavailable to you or unable to function as such information is required to provide such services.

For Providers, the Site offers a public profile feature, and in doing so, provides features enabling you to update, correct, or delete some of your profile information and preferences. Please note that while your changes are reflected promptly in active user databases, we may retain all information you submit for a variety of purposes, including backups and archiving, prevention of fraud and abuse, and analytics. You may also modify the cookie and location sharing settings on your device or in your web browser to limit the information you share.

You are responsible for maintaining the secrecy of your unique password and account information at all times. Please be careful with this information.

Access

You may correct, amend, or delete your personally identifiable information by editing your profile and personal information through the Site.

Deleting Your Account 

If you choose to delete your account, your personal data will generally stop being visible to others on our Site within 24 hours, however, we do retain your personal data even after you have closed your account if reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, or fulfill your request to “unsubscribe” from further messages from us. We will retain de-personalized information after your account has been closed.

Information you have shared with others (e.g., through private messages) will remain visible after you close your account or delete the information from your own profile or chat conversations, and we do not control data that other Registered Users have copied off the Site. Content and ratings or review content associated with closed accounts will show an unknown user as the source. Your profile may continue to be displayed in the services of others, such as the find or booking functions, until they refresh their cache.

Security 

We have implemented security safeguards in an effort to protect your information from unauthorized access, disclosure, alteration, and destruction. Despite our efforts, however, we cannot and do not guarantee the security of the information we collect from you or that such information will not be accessed, disclosed, altered, or destroyed by breach or other failure of any of our safeguards. Please keep this in mind before providing us with information or using our Service in a manner which you may wish to keep private.

Third Party Sites

We may share the personal information we collect with third parties as follows or as otherwise described in this Privacy Policy:

  • when you send or accept a Care Request;
  • when you sign up for and participate in the interactive areas of our Services, such as creating a user profile or writing a review;
  • with vendors, consultants, business partners, and other service providers who need access to such information to carry out work on our behalf;
  • in response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law, regulation or legal process.

International Users

We utilize servers and data centers located in Canada. If you choose to use the Service from outside Canada, then you should know that you are transferring your information (including personally identifiable information) outside of your region and into Canada for storage and processing. By providing your information to us through your use of the Service, you agree to that transfer, storage, and processing in Canada.

Also, we may transfer your data from Canada to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Service. You should know that each region can have its own privacy and data-security laws, some of which may be less stringent as compared to those of your own region.
